I have been retained by Mr. Frank DiTondo in order to conduct an investigation and respond to allegations made by a Dean Antalik in a report filed under #281173. I have had the opportunity to review Dean Antalik's remarks, interview Frank DiTondo, and review the written documents signed by the parties herein along with canceled checks made out to Mr. Antalik and his wife on behalf of Mr. DiTondo for various services rendered. It is my personal and legal opinion that Mr. Antalik has not been truthful and misrepresents the matters in dispute between these two (2) individuals. In my opinion, Mr. DiTondo has various civil causes of action he could pursue against Mr. Antalik, in addition to possibly filing criminal charges, however Mr. Antalik's Bankruptcy Filing on October 24, 2007, two days before the posting I am responding to, may make that course of action imprudent at this time. The following is a brief summary with respect to this business dispute:

Mr. DiTondo and Mr. Antalik entered into a contract whereby they would share equally the net profits of the book The One Minute Handicapper which Mr. DiTondo wrote based on his greater than 60 years of experience in the horse racing business. Mr. DiTondo compiled over 380 written pages of material and over 700 charts on handicapping. Mr. DiTondo has traveled the country to market this book and personally advanced over $30,000 of his money to publish and market the book. Without a legal obligation to do so, Mr. DiTondo also paid Mr. Antalik and his wife approximately $4,000 to scan and edit the charts into the book which was what Mr. Antalik agreed to do in order to obtain his 50% share. Mr. DiTondo also paid other individuals approximately $5,000 to edit and scan charts and materials that Mr. Antalik agreed to perform as part of his contractual obligation. .To date, the book has not generated any net profits due to the necessary up front publishing and marketing costs incurred by Mr. DiTondo..Mr. Antalik has not advanced any monies for this book. In turn, Mr. Antalik is doing anything he can to derail Mr. DiTondo's efforts to promote this book including posting the article referenced above.

Due to Mr. Antalik's inappropriate conduct, some of which is not addressed herein and the subject of investigations by state and federal authorities, Mr. DiTondo has decided to terminate his business relationship and contract with Mr. Antalik. Mr. Antalik's comment that he lost $150,000 in “time and service” with respect to his part time and incomplete efforts on this project is a ridiculous statement. Mr. Antalik's bankruptcy filing listed his total combined gross income for his computer consulting and part time weekend work for a chemical waste management company as $54,356 for the 94 week period from January 1, 2006 to October 24, 2007.

Mr Antalik's posting distorts the facts, is untruthful, malicious, unwarranted and a capricious attempt to discredit Mr DiTondo.
